The following legal notice is intended to regulate the use of the Web Site. www.reservanatura.org under oath, the Website Owner declares that its identification data are as follows:

For the interpretation of this document, the following terms shall be understood as follows:
2.1. Consideration: Financial remuneration - in a fixed amount - established by the Owner for the provision of its Service, variable, and available on the Website.
2.2. The Client and/or User: The natural person who accepts and contracts the Service from the Owner.
2.3. The Owner: Owner of the Web Site, the Centro Latinoamericano de Gestión Ambiental, A.C.
2.4. The Parties: The Owner and the Client.
2.5. Service: Digital reservation and visitor management system for public, private or community natural areas, called "Reserva Natura.
2.6. Website: Website, property of the Owner, identified with the domain www.reservanatura.org.
2.7. T&C: Terms and Conditions.
2.8. ANP Protected natural area.
2.9. CONANP National Commission of Natural Protected Areas.
3. Website
The Owner is the legitimate owner and possessor of the Web Site, which is duly registered and protected in accordance with the standards set forth by The Internet Corporation for Assigned Names and Numbers (ICANN), so all content therein is authored by the Owner and is intended to provide indicative information about the Service it provides.
Access to the Web Site is free of charge, so that the use of the Web Site confers the condition of User to whoever enters and implies the acceptance of the navigation conditions derived from it. It is expressly forbidden to use the Web Site for purposes harmful to the interests of the Owner, or that, in any other way, overload, damage the networks, servers, and other computer products (hardware) or software products and applications (software), property of the Owner.
4. Service
4.1. Reservation and confirmation for visits to natural areas. Consisting of a digital platform that allows the User to reserve his/her visit to the Balandra Flora and Fauna Protected Natural Area (APFF), in La Paz, Baja California Sur, including, but not limited to, the land entrance through the Balandra's main beach.
4.2. Confirmation of the Service. Once the date, visiting hours, number of visitors, and natural area of visit have been selected, the User will receive by e-mail a QR code, which may be scanned at the site of visit by the authorized personnel of the natural area for access to the site of visit, prior payment of the Service. Said e-mail will also indicate the instructions for accessing the visitation site and the means of contact with the Owner.
4.3. Scheduled times. The schedules for the provision of the Service from the Owner to the User will be subject to the availability of the Owner, however, they will always be visible on the Website for the eligibility of the User. In case of changes in the agreed schedules, these will be notified by email or by any instant messaging platform.
4.4. Means of contact. The Owner and the User agree that any type of communication regarding the Service will be carried out via email and/or instant messaging platforms.
4.5. Language. - The information contained in the Website and any type of communication between the Owner and the User shall be in Spanish and/or English.
5. Consideration
5.1. Cost of the Service. The Cost of the Service provided by the Owner will be available on the Website, which must be paid by the User to confirm the Service and receive it.
5.2. Acceptance. The Service shall be deemed confirmed with the registration and payment of the corresponding payment by the User to the Owner.
5.3. Payment Methods. The payment of the Service referred to in the Website is in Mexican pesos (National Currency), and is subject to the currency conversion rates of the User's country of residence; and the transaction may be made by any electronic payment platform or by cash deposits in authorized establishments.
5.4. Taxes and additional costs. The User accepts to cover additionally the local taxes of his/her country of residence that may be applicable due to the use of the electronic payment platforms.
5.5 Invoicing. The Owner acknowledges that it is able to issue Digital Tax Receipts via Internet (CFDI) on the service offered by Reserva Natura, i.e. the reservation platform. In order to obtain CFDIs for Local Management Fees, donations, or fees collected by CONANP, Reserva Natura may share its invoicing data without guaranteeing the receipt or response time.
5.6. Refunds. The User accepts that the amount paid for the Service for the use of the platform (not including local and royalty collection fees) may be refunded under the conditions indicated by the Owner and, if applicable, the fees and taxes established by the electronic payment platform through which the payment is made shall be paid.
Reserva Natura Cancellation and Refund Policy
Reservations and Payments:
By making a reservation through our platform to access protected natural areas, visitors accept the terms and conditions set forth in this policy.
1.2. Payments must be made online at the time of booking and will be processed through secure payment methods available on our platform.
Cancellations:
Reservation cancellations must be made through our online platform, following the established process and following the link provided in your confirmation email.
Cancellation policies may vary according to the type of reserve, the protected area and local regulations. Visitors should review specific cancellation policies at the time of booking. The following cancellation policies apply.
Cancellation with refund:
Cancellations made 72 hours prior to your reservation date and time to enter a natural area may be eligible for a partial refund of the amount charged for the reservation platform service. Bank transaction fees (3.6% + $3.00 mxn) will not be refundable. The reimbursement of local management fees will be under conditions established by each protected area and if you authorize it, Reserva Natura can share and request your invoice with them, without Reserva Natura being responsible for the resolution or response time of the same.
Cancellation without refund
Cancellations made within 72 hours prior to the date and time of the reservation to enter the protected natural area cannot be refunded.
Cancellation due to natural causes or force majeure: In exceptional cases, such as extreme weather conditions or other unforeseen events, protected areas may decide to cancel or close reservations and provide full or partial refunds at their discretion. If this is the case, please send direct mail to contacto@reservanatura.org. The following are considered force majeure: accidents, death of a family member, natural disasters.
Returns:
Refunds will be processed according to the corresponding cancellation policy and terms established by each protected area.
Refunds will be made through the same payment method used for the original reservation.
Refunds may take a certain period of time to process and appear in the visitor's account, depending on processing policies and payment methods.
Modifications:
Visitors may request changes to their reservations, such as changes in dates or details of services, up to 72 hours before the chosen time of their visit and according to the availability and policies of the protected area.
Changes may be subject to additional fees or price adjustments as established by the protected area.

6. Intellectual and industrial property rights
6.1. Derived trademarks. The ownership and rights derived from the trademarks -in any form-, present or future, main or secondary, projected on the Website and social networks of the Owner, including but not limited to -La Mano del Mono, local hands, global changes, Reserva Natura, Balandra Flora and Fauna Protection Area. are protected by the Federal Law for the Protection of Industrial Property, and with the corresponding trademark registrations, for which reason their unauthorized use by third parties is expressly prohibited.
6.2. Licenses. The patrimonial and moral rights that may derive from the development of the Service will be solely and exclusively of the Owner, who will have the power to exploit them exclusively and may grant licenses of use, which in order to be valid must be in writing and, if applicable, registered in the corresponding governmental offices.
7. Confidentiality of information
7.1. From the Owner. The Owner will keep with reserve all the information related to the Service that it provides for a period of five years, so the Owner agrees not to disclose, communicate or disseminate under any circumstances, with the exception of the injunction that the laws in force and competent courts determine.
7.2 Of the User. The User agrees to use the information contained in the Website in the manner permitted by the laws in force in Mexico.
7.3. Portfolio. The Owner may use the final results derived from the Service, including photographs, videos, testimonials and any type of digital content, in social networks and Website, and if applicable, will acknowledge the authorship of whoever corresponds. In any case, the User may request in writing, the removal of such content at any time to the Owner.
8. Resolution of complaints and claims
The User may express his/her opinion, suggestions, disagreements or any other type of opposition with respect to the methodology, processes, human capital or resources foreseen in the development of the Service, in writing, which must be sent to the following email address contacto@reservanatura.org.
9. Applicable Law and Jurisdiction
The present document shall be governed by the assumptions described above, therefore the Parties reciprocally accept that the rights and obligations herein conferred may not be assigned to third parties. For the interpretation and fulfillment of the rights and obligations derived from this document, the Parties submit to the jurisdiction of the competent courts of San Cristobal de las Casas, Chiapas, Mexico.
10. Acceptance and modifications
The User accepts and acknowledges the content of the T&Cs. Any subsequent changes will be notified by e-mail or will be published on the Website.
